Understand ownership before you sign

A monthly website agreement can describe an instalment plan, a managed service or an indefinite rental. Those models do not give clients the same rights, so ownership should be clarified before any deposit is paid.
The questions below help you identify who owns the website, domain, content and supporting assets. You can also review the wider PAYG WordPress website design guide.
The website files and database
A WordPress website consists of files, a database, a theme, plugins and media. Ask whether these can be exported and moved to another suitable host. A transferable WordPress build offers more practical independence than a closed platform controlled entirely by the supplier.
Some providers retain ownership while payments continue and transfer it after a minimum term. Others license access without ever transferring the underlying website. Both can be legitimate, but the distinction must be stated clearly.
Who should control the domain name?
Your domain is a key business asset. Ideally it should be registered in your name or business name, using contact details you can access. If a designer manages renewals, make sure the registration can be transferred and that you will receive adequate notice of renewal costs.
Written content and photography
Content supplied by the client normally remains the client’s property. Copy written by a designer or copywriter may transfer after payment, depending on the agreement. Stock photography, fonts and other licensed assets often remain subject to third-party terms.
Themes, plugins and licences
Premium WordPress software is commonly licensed by the developer while the site is hosted and maintained by them. If the website moves, you may need to purchase replacement licences. This can affect ongoing costs without preventing ownership of the site itself.
What happens at the end of the term?
The contract should say whether ownership transfers automatically, whether monthly support can continue and what information will be supplied if the site moves. It should also explain outstanding payments, notice periods and any migration charge.
A practical ownership checklist
- Who is the registered domain holder?
- Can the WordPress files and database be exported?
- When does ownership transfer?
- Which software licences must be replaced after a move?
- Who owns commissioned text and images?
- What notice and migration terms apply?
Helios sets these responsibilities out before work begins. See the managed pay-monthly WordPress website package for the current terms and inclusions.
